Este artículo analiza el papel de de las instituciones políticas sobre la distribución de recursos en procesos de negociación política. Para ello, recurrimos a la metodología experimental y estudiamos 3 instituciones políticas diferentes en el laboratorio, con el fin de determinar los resultados (desde el punto de vista del bienestar y de la igualdad) de la democracia y la participación directa en las instituciones. The paper aims to reconstruct the doctrinal evolution of the juridical thought in the transition from liberal constitutionalism - identifiable with the nineteenth-century theories of the "rule of law" - to democratic-social constitutionalism that inspires and shapes the "Welfare State". In short, democratic-social constitutionalism can be viewed as the fundamental core of the social pact through which the European and Western civilisation manages to provide a democratic alternative to the disintegration of the liberal states. The main features of the new constitutionalism will be analyzed by focusing on what, in our opinion, can be considered its main “pillars”.

Such a notion is used in the frame of the European Convenition on Human Rights, with a deep analysis of the Strasbourg organs case law on art. 17 ECHR. Adriano Olivetti (1901-1960) was the promoter of an unprecedented business project that not only concerned the economic sphere, but also included architecture, social development, politics, the value of the person and of the culture. This paper examines the educational role played by culture in the Olivetti’s project as a way of human growth. To clarify the identity of the Olivetti’s culture, various sources were questioned: the personal library, the editorial choices, his coworkers and the good educational practices carried out in the Olivetti factory. Starting from the discursive turn that has characterized democracy since the 80s of the last century, our article tries to outline a form of sustainable normativism. To do this, we use a theoretical framework derived from ancient Greek rhetoric and in particular from the reflection of Gorgias and Aristotle. In our perspective, on the one hand, the Gorgianic view is a useful reminder of the role that the pursuit of power and the possibility of conflict unavoidably play in the form of argumentation specific to the public sphere, that is, deliberation.
